OIG issues booklet to help physicians avoid fraud

By Diana Manos

The Office of the Inspector General has issued a booklet to help physicians avoid Medicare and Medicaid fraud, waste and abuse.

The OIG's new "Roadmap for New Physicians: Avoiding Medicare and Medicaid Fraud and Abuse" summarizes the five main federal fraud and abuse laws – the False Claims Act, Anti-Kickback Statute, Stark Law, Exclusion Statute and Civil Monetary Penalties Law – and provides tips on how physicians should comply with these laws in their relationships with payers, vendors and providers.

OIG officials said they created the booklet following a survey of medical school deans and officials at institutions that sponsor residencies and fellowships to learn what types of instruction medical students, residents, and fellows receive on Medicare and Medicaid fraud, waste and abuse. Nearly all respondents – 92 percent of deans and 90 percent of designated institutional officials – reported they would like the OIG to provide more educational materials.
